1. Acceptance of Terms

By accessing and using Rethink Rail ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.
2. Description of Service
Rethink Rail provides customer relationship management software including contact management, email marketing, SMS messaging, campaign management, and related features.
3. SMS Messaging Terms (10DLC Compliance)
Rethink Rail SMS Program
By opting in to receive SMS text messages from Rethink Rail, you agree to receive text messages at the mobile number you provided. This consent is specific to text messages only and does not include email or phone calls. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply.

3.1 Program Name and Description

Program Name: Rethink Rail SMS Notifications
Product Description: Customer relationship management platform providing SMS notifications, updates, marketing messages, appointment reminders, and other communications related to your business activities.
3.2 Opt-In Consent
By providing your mobile number and opting into our SMS program, you expressly consent to receive text messages from Rethink Rail. This opt-in is specific to text messages only and does not include consent for email communications or phone calls. Consent is not required as a condition of purchase or use of our services.

You may be asked to confirm your opt-in by replying YES or a similar keyword to complete the subscription process.
3.3 Message Frequency
Message frequency varies based on your account activity, campaign settings, and the services you use. During active campaigns, you may receive multiple messages per day. Recurring messages are possible depending on your subscription and settings.
3.4 Message and Data Rates
Message and data rates may apply. Standard messaging rates from your mobile carrier will apply for any messages sent to you from us and from you to us. The number of messages you receive will depend on your usage. Check with your mobile carrier for details about your specific messaging plan and any applicable charges.
3.5 How to Opt-Out (STOP)
You can cancel the SMS service at any time. Simply reply STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any message you receive from us.

After you send the STOP command, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us unless you opt-in again.

3.7 Supported Carriers

Compatible carriers include: AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, Cricket Wireless, MetroPCS, U.S. Cellular, Virgin Mobile, Alltel, Cincinnati Bell, C-Spire Wireless, Cellcom, Consumer Cellular, and many others.
Not all carriers are supported. T-Mobile is not liable for delayed or undelivered messages. Check with your carrier for compatibility and coverage details.
3.8 Privacy Policy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information, including your mobile phone number and SMS opt-in data.
4. User Accounts
You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

You must notify us immediately of any unauthorized use of your account or any other breach of security.

6. Messaging Compliance Requirements
Users of Rethink Rail must comply with all applicable laws and regulations governing electronic communications, including but not limited to:

Your Responsibilities: You are solely responsible for obtaining proper, documented consent before sending marketing messages to contacts. You must maintain records of consent, provide clear opt-out mechanisms, and honor opt-out requests immediately. Failure to comply may result in account suspension or termination.

7. Payment Terms
Subscription fees are billed in advance on a monthly or annual basis. Fees are non-refundable except as required by law or as explicitly stated in our refund policy.

While we strive for 99.9% uptime, we do not guarantee that the Service will be uninterrupted or error-free. We reserve the right to modify or discontinue the Service with reasonable notice.
10. Limitation of Liability
BreadCRM shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.
11. Indemnification
You agree to indemnify and hold harmless Rethink Rail from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
13. Termination
We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will immediately cease.
14. Governing Law
These Terms shall be governed by the laws of the United States, without regard to conflict of law provisions.
